Delivery of Goods and Risk                                       

Delivery times are estimate only and the Company is not liable for minor delays in the delivery. The Purchaser is not relieved of any obligation to accept or pay for Goods by reason of any delay in delivery.

Delivery of the Goods shall be made to the Customer's address. The Customer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.

The failure of the Company to deliver will not entitle the Customer to treat this Contract as cancelled

The Company wiil not be liable for any loss or damage whatever due to failure by the Company to deliver the Goods (or any part of them) promptly or at all.

All risk for the Goods passes to the Cusomer on delivery even if the Company retains ownership.

Delivery will be free in store (FIS) Australia wide for Orders in excess of $300.00+GST. However the Customer will be liable delivery charges if a delivery date is required outside of usual delivery times. Orders less than $450.00+ GST will be subject to the current freight charge.

Shortage

All items listed on the Company's invoice will be deemed to have been received in good order and condition, without shortage unless the Company is notified in writing to the contrary within seven (7) days of the delivery date.

When the Purchaser signs any delivery docket or consignment note or similar document in receipt of a delivery; it is conclusive of evidence that the Purchaser reveived the delivery without any shorage or damage that would have been visible without unpacking the Goods. The Purchaser carries all risk of Goods in transit where the Purchaser arranges for carriage.

Outstanding Interference

The Company shall not be liable to the Purchaser for any defect, loss, damage or delay whatsoever caused by strikes, lockouts, damage to or breadown of plant, Government interference, earthquake, flood, fire, civil commotion, Force Majeure, or any cause beyond the control of the Company.
